§ 103D.631 — Maintaining Projects

Watershed district managers must keep their projects in working condition. A maintenance fund pays for routine repairs. The fund is filled by pro rata assessments on properties that benefited from the original project, but cannot exceed 20% of the original construction cost.

If your property was assessed for benefits when a watershed project was built, you can be assessed again to maintain it. The maintenance fund is capped at 20% of the original construction cost. Assessments are filed as lien statements with the county recorder and collected like drainage assessments.
