2025 Session Last amended: 2024 session

§ 103D.707 — Projects Initiated by Managers

Plain-Language Summary

Watershed district managers can start projects on their own by passing a resolution, without needing a petition. The resolution must identify the project, name funding sources, and assign an engineer. Projects can be funded from levies, assessments, water management charges, or outside sources.

Practical Notes
This 2024 addition allows managers to initiate projects by resolution rather than waiting for a petition. The initial funding plan is not binding, but if managers later decide to expand the use of assessments, they must follow proper procedures to protect property owners’ rights. Benefit appraisals are only needed if the project uses assessments.
