§ 103D.715 — Appraisers; Determining Benefits and Damages

When a project will be funded by assessments, managers must appoint three independent resident appraisers to figure out how much each property benefits or is damaged by the project. The appraisers take an oath and are paid by the district. State-owned property can also be assessed for benefits.

Practical Notes
Appraisals are only required when projects are funded through assessments. The three appraisers must be disinterested state residents. Benefits and damages to state land follow special procedures under sections 103E.025 and 103E.315. If a state permit is needed, state land cannot be assessed until the permit is issued.
