§ 103D.801 — Procedure When Contract is Not Let

If all bids for a project are more than 30% above the engineer's estimate or exceed the net benefits, the managers must follow the procedure in section 103E.511, which typically involves rebidding or modifying the project.
103D.801 PROCEDURE WHEN CONTRACT IS NOT LET.
If all of the bids received are for a price more than 30 percent greater than the engineer’s estimate in the engineer’s report, or for a price in excess of the benefits less damages and other costs, the managers shall follow the procedure described in section 103E.511.

Practical Notes
This prevents projects from proceeding when costs have exceeded expectations. The 30% threshold and the benefits-minus-damages limit are separate triggers. If either is exceeded, the managers must follow section 103E.511’s procedures rather than simply awarding the contract.
