§ 103E.035 — Defective Notice

Plain-Language Summary

This section explains what happens when a required notice in a drainage proceeding has a mistake or defect. A small error in a notice does not automatically make the entire drainage proceeding invalid. The law provides ways to fix notice problems so projects are not thrown out over minor mistakes.

Practical Notes
If you received a notice about a drainage project that had an error (wrong date, misspelled name, etc.), the project may not be thrown out just because of that mistake. However, if the defective notice actually prevented you from participating in the process, you may have grounds to challenge the proceedings.
