2025 Session Last amended: 1990 session

§ 103E.241 — Engineer

Plain-Language Summary

Within 30 days after receiving a petition, the drainage authority appoints an engineer to conduct a preliminary survey. The engineer must be a registered professional engineer or the county highway engineer. The engineer takes an oath and posts a bond of at least $5,000.

Practical Notes
The appointed engineer plays a central role throughout the drainage proceeding, from initial survey through construction. The bond requirement protects property owners and the drainage authority from engineering negligence.
