§ 103E.311 — Viewer Duties

If the drainage authority decides at the final hearing that the project should not be built, it dismisses the proceedings. The petitioners are responsible for the costs incurred. If the project is dismissed because benefits do not exceed costs, a new petition for the same project requires a higher signature threshold.
103E.311 VIEWER DUTIES.
The viewers, with or without the engineer, shall determine the benefits and damages to all property affected by the proposed drainage project and make a viewers’ report.

Practical Notes
A dismissed project is not free. Petitioners must pay all costs including engineering fees and viewer expenses. This financial risk should be carefully considered before signing a drainage petition.
