§ 103I.681 — Permit for Underground Storage of Gas or Liquid

Plain-Language Summary

Anyone who wants to store gas or liquid underground in Minnesota — either by displacing groundwater with pressurized storage or by using natural rock formations as a reservoir — must first get an underground storage permit from the Commissioner of Natural Resources. The application must include maps, plans, and specs showing the proposed storage, and the commissioner must hold a public hearing before issuing a permit that involves groundwater displacement. The permit may only be granted if the storage is more than 500 feet deep, will not pollute groundwater, and serves a substantial public need.

Practical Notes
Natural gas utilities and pipeline companies that want to store gas in underground formations (a common practice for managing seasonal demand) must obtain this permit and satisfy strict findings about depth, groundwater protection, and public necessity. The public hearing requirement gives landowners and communities a formal chance to participate. A permit fee schedule is adopted by the commissioner and fees fund ongoing monitoring and inspection costs.
