§ 115A.415 — Substandard Disposal Facilities

Since July 1, 1995, no one may deliver or accept unprocessed mixed household trash at a substandard disposal facility. A substandard facility is one that does not meet the design and construction standards for new landfills that were in effect as of January 1, 1993. Waste must go through at least one processing step before it can be placed in such a facility.

Practical Notes
This law effectively closed older landfills to unprocessed household waste. Waste haulers must ensure their loads go to compliant facilities or that waste is processed first. Storage, exchange, and transfer alone do not count as processing.
