§ 115A.83 — Wastes Subject to Designation; Exemptions

Designation applies to mixed municipal solid waste and other solid waste that is not already being managed as a separate stream at a higher level on the waste hierarchy. Practical Notes
Source-separated recyclables and hazardous waste are exempt from designation. This protects recycling programs from being undermined by facility designation orders. Waste already being managed at a higher level than the designated facility would provide is also exempt.
