§ 115A.84 — Designation Plan

Plain-Language Summary

This law requires counties and districts to adopt a designation plan before they can require waste to go to a specific facility. The plan must evaluate the benefits and costs of designation, its effects on existing waste businesses, and the financial viability of the designated facility.

Practical Notes
The designation plan must be approved by the commissioner before the county or district can proceed. The plan must include a public hearing process and show that designation serves the public interest without unreasonably harming existing waste management businesses.
