§ 115A.9155 — Disposing of Certain Dry Cell Batteries

Plain-Language Summary

This section bans throwing certain types of rechargeable and specialty batteries — including nickel-cadmium, sealed lead-acid, mercuric oxide, and silver oxide batteries — into regular trash if they were used by government agencies, businesses, medical facilities, or communications companies. Manufacturers of these batteries must set up a collection and recycling system for buyers in Minnesota and provide a phone number for battery return information.

Practical Notes
Businesses, hospitals, government offices, and other institutional users cannot simply trash these batteries — they must use the manufacturer’s collection system or another proper recycling channel. Battery manufacturers must actively maintain a return or recycling program and inform buyers how to use it. Manufacturers who comply with this section are protected from liability if someone else later improperly disposes of the battery.
