§ 115A.919 — County Fee Authority

Plain-Language Summary

This section allows counties to impose per-cubic-yard fees on operators of solid waste disposal facilities and construction debris facilities within the county. Fees must be used for landfill cleanup, closure costs, postclosure care, and mitigating local impacts. Construction debris facilities face a 50-cent-per-cubic-yard cap, and the total revenue that can be collected from those facilities is limited. Certain waste residue from recycling and energy recovery facilities is exempt if there is at least an 85 percent weight reduction.

Practical Notes
Landfill and construction debris facility operators need to understand county fee structures because these fees affect operating costs. Recycling and waste-to-energy facilities that achieve 85 percent weight reduction can get an exemption from county fees — but must follow verification procedures first. If a facility is owned by a joint powers board, fee increases above $1 per cubic yard need board approval.
