§ 115A.93 — Licensing; Solid Waste Collection

Plain-Language Summary

This section requires waste haulers to get a local license before collecting mixed municipal solid waste for hire and to register with the MPCA if collecting recyclables for hire. Licensing authorities must require variable pricing that charges more for larger amounts of waste collected, and cannot allow haulers to charge recycling customers more than non-recycling customers. Haulers must annually report collection amounts by waste type, customer type, county, and destination.

Practical Notes
Anyone collecting trash for pay in Minnesota needs a local license — no license means no legal operation. Haulers must use tiered pricing that discourages waste generation, and they are specifically prohibited from penalizing customers who recycle. Customer lists provided to counties and cities are classified as private or nonpublic data under Minnesota’s data practices law.
