§ 115A.956 — Solid Waste Disposal; Problem Materials

Plain-Language Summary

This section requires the MPCA to develop a plan identifying problem materials — hazardous or difficult-to-manage items that should not go in regular trash — and to plan for their separate collection and proper disposal. Once sufficient processing and disposal capacity is confirmed, the agency can make rules that ban specific problem materials from mixed municipal solid waste.

Practical Notes
This planning requirement is the foundation for many of Minnesota’s bans on specific items in regular trash, including household hazardous waste. The agency’s plans affect what counties must include in their solid waste management planning. Businesses and municipalities should be aware that the agency can expand the list of banned materials through rulemaking.
