§ 115B.14 — Awarding Costs

115B.14 AWARDING COSTS.
Upon motion of a party prevailing in an action under sections 115B.01 to 115B.15 the court may award costs, disbursements and reasonable attorney fees and witness fees to that party.

Practical Notes
The court has discretion to award or deny fees, so winning does not guarantee fee recovery. Both plaintiffs and defendants can request fees if they prevail. This provision can make environmental litigation expensive for the losing party, which encourages settlement.
