2025 Session Last amended: 1983 session

§ 115B.14 — Awarding Costs

Plain-Language Summary

The winning party in a lawsuit under this act can ask the court to award costs, disbursements, reasonable attorney fees, and witness fees. This is not automatic; the winning party must file a motion requesting these costs.

Practical Notes
The court has discretion to award or deny fees, so winning does not guarantee fee recovery. Both plaintiffs and defendants can request fees if they prevail. This provision can make environmental litigation expensive for the losing party, which encourages settlement.
