§ 115B.175 — Voluntary Response Actions; Liability Protection; Procedures

Plain-Language Summary

This section creates a voluntary cleanup program that protects people from environmental liability. If you clean up a contaminated property according to a plan approved by the commissioner, you and future owners, lenders, and developers can receive protection from liability for that contamination. The section also allows responsible parties to complete cleanup and obtain liability protection for future buyers of the property.

Practical Notes
This is a key tool for brownfield redevelopment. Developers and buyers of contaminated property can clean up the site voluntarily and receive a certificate of completion that protects them from future liability. The protection extends to lenders and successors. However, the protection does not apply if you got approval through fraud, if you were already responsible for the contamination, or if you make contamination worse. Partial cleanups are allowed if the remaining contamination will not be worsened.
