§ 115B.177 — Owner of Real Property Affected by Off-site Release

Plain-Language Summary

If contamination on someone else's property spreads onto your property, the commissioner can issue a written determination or agreement that the state will not take legal action against you. To get this protection, you must allow access to your property for cleanup and agree not to interfere with response actions. The protection can extend to future owners of your property.

Practical Notes
This section helps property owners who are innocent victims of a neighbor’s contamination. The protection can be revoked if new information shows your property is actually a source of the contamination. You must cooperate with cleanup efforts on your property to maintain the protection. This is especially useful for homeowners near industrial sites or Superfund sites.
