§ 115B.20 — Actions Using Money From Remediation Fund

Plain-Language Summary

This section lists what the remediation fund money can be spent on. Allowed uses include investigation and cleanup of contaminated sites, enforcement activities, providing alternative water supplies, assessing and restoring damaged natural resources, acquiring property for cleanup, and reimbursing political subdivisions for emergency response costs. State agencies must report to the legislature on how the money was spent.

Practical Notes
State money cannot be used for cleanup costs that could be covered by federal Superfund dollars. Cities and counties that are not responsible for contamination can be reimbursed for emergency response costs. Political subdivisions that exceed their liability caps can also get reimbursement. Reports on spending are due to the legislature by January 31 of each odd-numbered year.
