§ 115B.29 — Eligible Persons

A person who was injured or whose property was damaged by exposure to a harmful substance released from a facility in Minnesota may file a compensation claim with the state Pollution Control Agency. The claim can cover personal injuries — such as cancer or nervous system disorders — that could reasonably have resulted from the toxic exposure, as well as property damage caused by the harmful substance.

This section is part of Minnesota’s Harmful Substance Compensation Program, which provides a no-fault alternative to suing responsible parties when victims cannot identify or recover from the polluters. Claimants do not need to file a lawsuit first — they file directly with the agency.
