§ 115B.30 — Eligible Injury and Damage

To qualify for compensation from the state's harmful substance fund, a personal injury must be a medically verified chronic or progressive disease (such as cancer or nervous system disorders) that could reasonably have resulted from exposure to a released harmful substance in Minnesota. Property damage claims require showing the damage results from a harmful substance released from a nearby facility. Claims for personal injury must be filed within two years of discovering the injury and its connection to the toxic exposure.

Practical Notes
Workers’ compensation injuries, injuries from consumer products, and injuries caused by substances for which the claimant is responsible are excluded from the fund. The two-year filing deadline runs from when the connection between the injury and the exposure was or should have been discovered — not from the date of exposure — which is important for diseases with long latency periods like cancer. Property damage claims must wait until the full amount of the loss can be determined before the two-year clock starts.
