§ 115B.52 — Water Quality and Sustainability Account

This section creates the water quality and sustainability account in the remediation fund, funded by Minnesota's 2018 settlement with the 3M Company over PFAS (per- and polyfluoroalkyl substance) contamination in the east metropolitan area around Woodbury, Oakdale, Lake Elmo, Cottage Grove, and nearby communities. Money in the account is appropriated to the Pollution Control Agency and Department of Natural Resources for projects authorized under the settlement. The commissioners must report annually to the legislature on how the money is spent and submit a spending plan each October.

The 3M settlement fund is specifically targeted at water quality and sustainability projects in the affected east metro communities. Cities and townships in the east metropolitan area (including Woodbury, Oakdale, Lake Elmo, Cottage Grove, Newport, Afton, St. Paul Park, West Lakeland Township, and Grey Cloud Island Township) are the primary intended beneficiaries. Importantly, before either commissioner can take over or operate a municipal water supply in the east metro area, they must get approval from the local government — the state cannot unilaterally assume control of local water systems.
