§ 115C.021 — Responsible Person

Plain-Language Summary

A person who owns or operates a petroleum tank is generally responsible for cleaning up any release or leak from that tank. There are exceptions for people who did not know about a tank on their property and did not contribute to the release.

Practical Notes
If you buy property with an old underground tank you did not know about, you may not be held responsible for a pre-existing leak. However, once you learn about the tank, you must report it and not make the problem worse.
