§ 116B.10 — Civil Action Against State

Plain-Language Summary

This section allows environmental lawsuits to be brought against the state of Minnesota and its agencies. Government entities are not immune from MERA claims when their actions cause environmental harm.

Practical Notes
The state government can be sued under MERA just like a private company. Sovereign immunity does not protect government agencies from claims that their actions are harming the environment.
