§ 117.012 — Preemption; Public Use or Purpose

This section says that all government bodies in Minnesota must follow the same eminent domain rules in this chapter. Eminent domain can only be used for a public use or public purpose. Drainage and town road projects have their own separate rules.

Practical Notes
If the government wants to take your property, it must prove the taking is for a public use or purpose. Cities cannot create their own rules that give property owners fewer protections than this chapter provides. Drainage projects under chapters 103D and 103E follow their own procedures.
