§ 117.086 — Noncontiguous Tracts, Treatment as Unit

If you own separate pieces of land that are not next to each other but are used together, they can be treated as one unit for calculating damages. This applies when taking land from one tract hurts the value or use of the other tract.

Practical Notes
If you have a farm with fields on both sides of a road and one field is taken, you may argue the other field is also damaged. You must include the unity claim in your notice of appeal. The government can ask the court to decide as a matter of law whether the tracts qualify as a unit.
