§ 13.37 — General Nonpublic Data

Plain-Language Summary

This section classifies certain types of government data that are not about individuals as nonpublic or protected nonpublic. This includes trade secret information, security information, sealed bids before opening, and data whose premature release would give an unfair advantage.

Practical Notes
Not all non-public government data is about people. This section protects things like: trade secrets submitted to the government, sealed bids until bid opening, internal government security information, and attorney work product. If an agency denies your request citing this section, they must specify which category applies.
