§ 134.07 — Public Library Service

Any city or county in Minnesota may establish a public library for its residents. The governing body can designate public property for library use and levy an annual property tax to fund the library — proceeds go into a dedicated library fund. Counties cannot tax property that is already taxed for public library service by a city.

This is the foundational authority for city and county public libraries in Minnesota. A city or county that wants to establish a library can simply pass an ordinance or resolution — no vote is required unless a petition is filed under section 134.08. The library fund is kept separate from general city or county funds and is controlled by the library board.
