§ 14.101 — Advice on Possible Rules

Plain-Language Summary

Before an agency formally proposes a new rule, it must publish a notice in the State Register at least 60 days in advance asking for public comments. The notice must describe what the agency is considering and who might be affected. Agencies can also create advisory committees to help develop rules. A rule will not be thrown out just because this notice was imperfect, as long as the agency tried in good faith.

You can submit comments during this 60-day period before the agency even formally proposes a rule. The chief administrative law judge can shorten the comment period to 30 days for good cause.
