§ 14.125 — Time Limit on Authority to Adopt, Amend, or Repeal Rules

Plain-Language Summary

When the legislature gives an agency authority to make rules, the agency must publish notice of intent to adopt those rules within 18 months. If the agency misses that deadline, its authority to make those rules expires permanently. Once the agency starts the process on time, it can later amend or repeal the rules without needing new legislative permission.

Practical Notes
This 18-month deadline prevents agencies from sitting on rulemaking authority indefinitely. If an agency fails to start the rulemaking process in time, it cannot use other existing laws as a workaround to adopt those same rules. This provision encourages agencies to act promptly when the legislature directs them to adopt rules.
