§ 14.127 — Legislative Approval Required

If a proposed rule would cost more than $25,000 in the first year for any small business (under 50 employees) or small city (under 10 employees), the rule needs legislative approval before it can apply to those businesses or cities. Small businesses and cities can claim a temporary exemption by filing a written statement. Exceptions exist for federally mandated rules and when the governor issues a waiver.

Practical Notes
If you run a small business or work for a small city, and a proposed state rule would cost you more than $25,000 in its first year, you can file a written statement with the agency to claim a temporary exemption. The rule then will not apply to you until the legislature approves it. The governor can waive this requirement. Rules from the Public Utilities Commission are exempt.
