§ 14.45 — Rule Declared Invalid

Plain-Language Summary

A court must declare a rule invalid if it violates the constitution, goes beyond the agency's authority, or was adopted without following proper rulemaking procedures. Either side can appeal the Court of Appeals' decision to the Minnesota Supreme Court.

Practical Notes
There are three grounds for invalidating a rule: constitutional violations, exceeding statutory authority, or procedural failures. If the Court of Appeals rules against you, you can appeal to the Supreme Court. The same appeal right exists for the agency.
