§ 14.62 — Decisions, Orders

Plain-Language Summary

Every agency decision in a contested case must be in writing with findings of fact and legal conclusions. If the agency rejects or changes the administrative law judge's findings, it must explain why. The judge's decision becomes final after 90 days unless the agency acts. Agencies can request remand for additional fact-finding.

Practical Notes
The agency has 90 days after the record closes to modify or reject the administrative law judge’s decision. If the agency does not act within 90 days, the judge’s decision becomes final. You will receive a copy of the final decision by first class mail. If you disagree with the decision, you can seek judicial review.
