§ 14.68 — Procedure on Review

Plain-Language Summary

The Court of Appeals reviews contested case decisions based on the record and the arguments of the parties. The court can affirm, reverse, modify, or remand the decision. The standard of review is deferential to the agency's factual findings but less so to legal conclusions.

Practical Notes
On judicial review, the court looks at the agency’s record to decide if the decision was proper. The court gives some deference to the agency’s expertise on factual matters. Legal arguments should focus on the grounds listed in section 14.69.
