§ 142B.40 — Special Conditions for Residential Programs

Plain-Language Summary

This section protects small residential programs from being blocked by zoning laws. Programs with six or fewer residents must be treated as single-family homes for zoning purposes. It also requires foster care license holders to notify the licensing agency of any health changes that could affect their ability to care for foster children.

Practical Notes
Cities and towns cannot use zoning to prevent small group homes or foster care homes from operating in residential neighborhoods. Restrictive covenants requiring owner-occupancy or that all occupants be related cannot block these programs. Foster care providers must immediately report any physical or mental health changes that could affect their ability to care for children.
