§ 142B.50 — Disclosure of Communicable Disease

Plain-Language Summary

This section requires county agencies, private child-placing agencies, and individuals placing children in licensed foster care to disclose any known communicable disease to the foster care license holder before the placement occurs. The agency must also confirm that the foster care provider has the ability to care for a child with that disease.

Practical Notes
Foster care providers have a legal right to know about a child’s known communicable disease before accepting a placement. Agencies that skip this disclosure step are violating the law. Foster care providers who believe an agency failed to disclose a known communicable disease should document the situation and contact the Department of Children, Youth, and Families.
