§ 142B.54 — Requirements; Maltreatment of Minors or Vulnerable Adults

Plain-Language Summary

This section requires child care license holders (except home-based and family foster care) to conduct an internal review within 30 days whenever there is a known report of suspected child maltreatment involving their program, and to take corrective action if needed. Child care centers must also develop a written risk reduction plan that identifies and addresses physical and environmental hazards, supervision procedures, and common injury risks, and must review and update it each year. Private child-placing agencies and family child foster care providers must provide annual training on maltreatment reporting requirements to all mandatory reporters.

Practical Notes
Child care centers that learn of a maltreatment report — whether internal or external — must complete a documented internal review within 30 days. The risk reduction plan is a live document that must be updated yearly and after any significant incident. Staff must be informed of plan changes in writing. Inspectors may ask to see both the internal review checklists and the current risk reduction plan during licensing visits.
