§ 142B.71 — Family Child Care Health and Safety Requirements

Plain-Language Summary

This section sets health and safety requirements for licensed family child care providers, covering allergy prevention (license holders must get allergy information from parents before enrollment and keep it current), bodily fluid handling, emergency preparedness (providers must have a written emergency plan with evacuation routes and procedures updated at least annually), transporting children (seat belt and car seat laws apply), and telephone access (a charged cell phone satisfies the phone requirement).

Practical Notes
Family child care providers must complete and document their emergency preparedness plan using the commissioner’s form, train all caregivers on it before they provide care, and run drills as required. Allergy information must be available to all caregivers at all times. Providers who use a cell phone as their required telephone must keep it charged and accessible during all care hours.
