§ 142B.72 — Family Child Care Physical Space Requirements

Plain-Language Summary

This section sets physical safety requirements for homes licensed as family child care programs, including rules for emergency escape routes (every bedroom and basement used for child care must have two ways out), fire safety (a fire extinguisher in or near the kitchen, carbon monoxide alarms within ten feet of rooms where children sleep, and working smoke alarms), heating system clearances (18 inches from gas or oil heaters, 36 inches from wood-burning appliances), garage door fire separation, and stairway safety (handrails, guardrails, and gates for infants 6-18 months).

Practical Notes
Licensed family child care homes must meet these physical space requirements as a condition of licensure. Providers in older homes may face challenges meeting the window escape route dimensions — homes built before March 31, 2020 use slightly different size standards than newer construction. Any variance from fire safety standards requires written approval from the state fire marshal. Inspectors check these requirements at initial licensing and at renewal.
