§ 142E.58 — Data Privacy

This section governs how personal and financial information collected through the Child Care Assistance Program is classified and shared. Most data collected from families and providers is classified as private or confidential under Minnesota's Data Practices Act. The state may share data with other agencies as needed to administer the program and investigate fraud.
142E.58 DATA PRIVACY.
Data of any kind obtained or created in relation to a provider or recipient investigation under this chapter is defined, classified, and protected the same as all other data under section 13.46, and this data has the same classification as licensing data.

Practical Notes
Families and providers have privacy rights regarding their program information, but the state can share data with law enforcement, other benefit programs, and federal agencies when required. Unauthorized disclosure of private data by state or county workers is prohibited and can result in disciplinary action. Individuals have the right to access their own data held by the program.
