§ 142G.11 — Eligibility; Citizenship

This section sets the citizenship requirements for MFIP. You must be a U.S. citizen, a qualified noncitizen (such as a refugee or someone granted asylum), or someone lawfully living in the United States. Some noncitizens who entered after August 1996 must wait five years before they can receive TANF-funded benefits.

Practical Notes
Refugees, people granted asylum, and veterans are exempt from the five-year waiting period for TANF funds. Even if federal TANF dollars cannot be used, the state may still fund MFIP benefits for lawfully residing noncitizens using state money. Undocumented immigrants and nonimmigrant visa holders are not eligible for MFIP.
