§ 144G.10 — Assisted Living Facility License

Beginning August 1, 2021, all assisted living facilities in Minnesota must be licensed by the Department of Health. Each building needs its own license, though campus facilities can get a single license for multiple buildings. There are two license categories: standard assisted living, and assisted living with dementia care. Operating without a license is a misdemeanor. Starting January 1, 2027, only licensed facilities can use the phrase 'assisted living' in their name or marketing.

Practical Notes
If you operate an assisted living facility, you must have a current license displayed at the main entrance. Unlicensed operation is a crime. If you are choosing a care facility for a family member, you can verify licensing status with the Minnesota Department of Health. Starting in 2027, facilities that use the words ‘assisted living’ in their marketing must be licensed — protecting consumers from unlicensed facilities using that term.
