§ 144G.13 — Background Studies of License Applicants

Plain-Language Summary

Before an assisted living facility license is issued, renewed, or transferred, all managing officials and direct-ownership interest holders must complete a background study. Anyone who has been disqualified under Minnesota's background study law cannot be involved in managing or controlling a facility. Background study data is classified as private.

Practical Notes
If you want to own or manage an assisted living facility, you must pass a background study before receiving or renewing a license. A disqualification bars you from management roles unless the disqualification is set aside. Facilities can fire staff based on confirmed criminal convictions from background study results without facing employment discrimination claims.
