§ 149A.94 — Final Disposition

Plain-Language Summary

All dead bodies must receive a lawful final disposition: burial, cremation, alkaline hydrolysis, or natural organic reduction (effective July 2025). Burial must be in an established cemetery. Cremated, hydrolyzed, or naturally reduced remains may be buried, placed in a niche, kept by the family, or scattered with property owner permission.

Practical Notes
Families have many options for final disposition of remains. Cremated or hydrolyzed remains can be scattered on private land with the owner’s written permission, or in areas with no local prohibition. Green burial without embalming or a vault is also a recognized option.
