§ 152.025 — Controlled Substance Crime in the Fifth Degree

Plain-Language Summary

Defines fifth-degree controlled substance crimes, the lowest-level drug felony in Minnesota. Covers sale of Schedule IV substances and simple possession of any Schedule I-IV controlled substance (excluding cannabis). Also covers obtaining controlled substances by fraud or false pretenses. Penalties range from a gross misdemeanor for small first-time possession to up to 5 years in prison and $10,000 in fines.

Practical Notes
This is the most commonly charged drug possession offense. First-time offenders possessing a small amount (under 0.25 grams or one dosage unit) face only a gross misdemeanor. Section 152.18 provides a mandatory stay of adjudication for eligible first-time fifth-degree offenders, meaning the charge can be dismissed after successful probation. Law enforcement may also offer a referral to substance use treatment instead of arrest.
