§ 152.097 — Simulated Controlled Substances

It is a crime to sell or try to sell a fake substance while pretending it is a real controlled substance. The penalty is up to three years in prison and a $20,000 fine. It is not a defense that you believed the substance was actually a real drug.

Practical Notes
This law targets people who sell fake drugs (like selling baking soda as cocaine). Even if you genuinely thought the substance was a real drug, you can still be convicted. Doctors and pharmacists prescribing placebos are exempt.
