§ 168A.16 — Inapplicable Lien or Security Interest

Plain-Language Summary

Minnesota's vehicle title law does not apply to certain types of liens and security interests. Mechanic's liens and other service liens given by law, federal government liens, and manufacturer or dealer security interests on vehicles held for sale are excluded. Government liens held by the state or local governments are also excluded from the security interest provisions.

Practical Notes
Auto repair shops have a statutory lien right over vehicles they repair, which does not need to be reflected on the title to be valid. Manufacturers and dealers holding vehicle inventory do not need to file security interests on those vehicles. These exclusions prevent the title system from being burdened with liens that have their own separate legal mechanisms.
