§ 168B.035 — Towing Authorized

Plain-Language Summary

This section authorizes local law enforcement agencies and their contracted towing companies to tow vehicles that are illegally parked or abandoned on public property. It also authorizes the Minnesota Department of Transportation's freeway service patrol to tow disabled vehicles in the Twin Cities metro area. A formal towing order from a law enforcement officer or authorized official is required before a vehicle can be towed from public property under this section.

Practical Notes
The requirement for a formal towing order provides an important check on unauthorized towing. Vehicle owners whose cars are towed from a public street should be able to obtain a copy of the towing order, which must document the legal authority for the tow. The freeway service patrol provision helps keep metro-area freeways clear of disabled vehicles, improving safety and traffic flow without requiring the vehicle owner to arrange their own towing.
