§ 168B.09 — Disposal Authority

Plain-Language Summary

Local governments can dispose of abandoned vehicles through contracts with private towing and scrap companies, or by using their own personnel and equipment on a limited basis. Governments must follow bidding procedures for contracts. Local governments are also allowed to adopt their own ordinances about abandoned vehicles, as long as those rules are at least as strict as the state law. They cannot adopt rules that are weaker than the state minimum standards.

Practical Notes
The bidding requirement for disposal contracts prevents favoritism and ensures governments get competitive rates for abandoned vehicle removal. The authorization for local ordinances allows cities and counties to customize enforcement to their specific needs—for example, a city with a severe abandoned vehicle problem might adopt stricter time limits or higher fees. However, local rules can only add to state protections, not reduce them.
