§ 169.306 — Use of Shoulders by Buses

Plain-Language Summary

Transit buses and Metro Mobility buses may drive on freeway shoulders when traffic is slow (under 35 mph). They cannot go more than 15 mph faster than main traffic or exceed 35 mph on the shoulder. They must yield to merging and exiting traffic.

Practical Notes
If you see a bus driving on the freeway shoulder during a traffic jam, it is likely legal. These buses must yield to vehicles entering and exiting the freeway. This does not apply to private vehicles.
